Apple’s iPhone 5 release date is months away. But it is fighting for the possession of iPhone5.Com
Apple 5 is still months away and no one is sure if Apple will call its forthcoming iPhone version exactly by this name. Even the last iPhone version iPhone 4S that was launched late last year was expected to be an iPhone 5 and not iPhone 4S.
But notwithstanding the actual launch of iPhone 5, there is a raging war going over the name of URL of iPhone 5. This is the first time that Apple has pursued to take possession of a URL of its future product, otherwise, often, it is not interested in taking the possession of URLs of its future products.
In many cases Apple doesn’t really care about the URLs of its products and iPhone4.com was not in possession even a year after its launch. The same was the case with iPhone4s.
Apple has filed a case with WIPO and the case number is D2012-0951. But there is no certainty as to when Apple filed the case with WIPO.
Meanwhile the Whois data base doesn’t show the person who has registered the website in his name. But what is astounding is the fact that the person who got it registered got it for 13 long years. He seems to be a good investor and decided to register iPhone 5 as long ago as year 2008.
Meanwhile there is speculation as to why Apple is taking step to take control of iPhone5 URL. An expert has this to say, “IP law is messed up these days, and, as you say, many times companies feel they have to be aggressive defending their turf, or they may end up losing it later. It’s terrible legal policy that we’ve inherited from real property concepts developed in common law. At one point it made sense to put land to productive use as opposed to favoring land speculation, therefore squatters, farmers and people with dubious title were often given far more rights. Today, IP law is encouraging practices that hinder technological innovation, exactly counter to its purpose”.
